Scope: State of Texas, Private Work

Time Constraints: This notice must be served on the owners, lenders and sureties before actually filing your lien claim. You must have served the required preliminary notices for this job or you cannot claim a lien. This notice should be the third notice in the series you are sending (first notice to General Contractor, Second to General Contractor and Owner, this notice to both)

No notice is required for liens on railroad property.

Information Requirements: Program information.

Form Types: Notice of Intent to File a Lien and Exhibits A-D, if needed.

Procedures: Send copies of the prepared forms by certified mail to the owner, lenders and sureties (if known). If you have not been paid in full by the end of the 10 day warning period you may file your lien.
