Note: For specific information on a state filing, see the state listing for its bond or lien claim notice. States requiring lien notices are noted at the end of this memo.

Description: A notice given by a contractor, subcontractor or supplier to the owner of the project property, and usually to the lenders and the general contractors, that the person giving the notice has performed labor, furnished materials, provided services or rented equipment for a job and has exercised their right to lien said property (as the case of a private work) or reserve moneys (in the case of a public work) for non-payment of the amount due.

Scope: A Lien Notice is required for these states:

Private Works: AZ ID KS IL MT NC NH NV OK OR PA TN TX SC UT VA WA WY

Public Works: None

Procedure: This notice is always printed as a statutory document in conjunction with a private Bond or Lien Claim. It must be served on the owners. Service generally may be by certified or registered mail, or optionally by personal service. A few states require personal service. Required service forms are printed.
